Delhi Court Calls for Improved Investigation in Narcotics Seizure Case
New Delhi, March 29 - In a significant development within the legal and law enforcement landscape of the city, a court has expressed its disapproval of the investigative approach taken in a narcotics seizure case. The court has called for an action taken report against a city police personnel, highlighting concerns over the handling of the case. This directive was issued by Special Judge Ekta Gauba Mann, who pointed out the investigative lapses while presiding over a case involving narcotics.

The case in question involved accused individuals Shabnam, Anita, and Chand Babu, who were being prosecuted under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The investigation was led by Assistant Sub-Inspector Naresh Kumar, under the supervision of the Special Commissioner of Police's crime branch. However, the court noted significant shortcomings in the investigation process.
During the proceedings on Wednesday, Judge Mann criticized ASI Kumar's decision-making in arresting certain individuals while allegedly allowing the main accused, Farman Ali, to evade capture. Ali was described as the supplier of the contraband involved in this case. Furthermore, the court observed that no investigative efforts were made to explore the involvement of Rahees, who was alleged to be the head of this narcotics racket.
The court's remarks underscored a concerning scenario where law enforcement personnel, tasked with safeguarding society from criminal activities, might inadvertently facilitate crime through selective enforcement. The judge emphasized that it is unacceptable for an Investigation Officer to focus solely on minor offenders while neglecting to pursue those at the helm of criminal operations.
In response to these findings, Judge Mann has ordered that a copy of her directive be forwarded to the Delhi Special Commissioner of Police (CP), Crime Branch. This step is aimed at ensuring that necessary actions are taken against ASI Naresh Kumar for his handling of the investigation. The court has mandated that an action taken report be submitted by the Special CP, Crime Branch, within one month from the date of the order.
This development raises questions about the effectiveness and integrity of narcotics investigations conducted by city police forces. It also highlights the judiciary's role in overseeing law enforcement practices and ensuring that justice is served without bias or negligence. The outcome of this directive and any subsequent actions taken against ASI Kumar could have implications for future investigations and potentially lead to reforms in investigative procedures within the police force.
