On May 2, a contractual female employee at the governor's residence accused Bose of molestation, leading to an investigation by the Kolkata Police. Banerjee had commented that women informed her they were scared to go to Raj Bhavan due to recent incidents reported there. She reiterated this claim in court on Monday.
Legal Proceedings and Arguments
During the hearing, Banerjee's lawyer argued that she was merely voicing women's concerns about alleged activities at Raj Bhavan. The counsel expressed readiness to provide an affidavit with the names of women who shared these fears. According to Article 361 of the Constitution, a governor cannot face criminal proceedings while in office.
Representing the governor, his counsel sought to prevent Banerjee and other Trinamool Congress members from making further comments on the alleged incident. The plea's maintainability was questioned by Banerjee's counsel, who also argued that Justice Rao's court lacked jurisdiction over the matter.
Supreme Court Involvement
On July 4, the woman who accused Bose moved the Supreme Court against the immunity granted to governors under Article 361. She requested the top court to determine whether sexual harassment and molestation are part of a governor's official duties, thus granting him blanket immunity.
