Bombay High Court Confirms Rs 3-Crore Compensation for Domestic Violence Survivor
In a significant ruling, the Bombay High Court has affirmed a trial court's directive for a husband to compensate his estranged wife with Rs 3 crore and a monthly maintenance of Rs 1.5 lakh. This decision comes in light of the severe impact of domestic violence on the victim, encompassing not just physical harm but also mental and emotional distress. Justice Sharmila Deshmukh emphasized the necessity of evaluating compensation on a case-by-case basis, considering the profound effects of such violence on the aggrieved individual.

The case, which spans over two decades of marital discord, saw the couple initially marrying in Mumbai in January 1994 and subsequently moving to the USA, only to return to Mumbai in 2005. The wife filed a domestic violence case in July 2017, detailing continuous abuse that began as early as their honeymoon and persisted during their time in the USA. The trial court's January 2023 order was based on corroborated evidence of domestic violence, leading to the substantial compensation awarded to the wife.
Furthermore, the husband is mandated to provide suitable accommodation for his wife in Mumbai's Dadar area or alternatively cover house rent amounting to Rs 75,000. He is also required to return all jewellery and belongings to her. Challenging the trial court's decision, the husband's revision petition was dismissed by the High Court, which upheld the compensation for the wide-ranging abuse suffered by the wife.
This landmark judgment underscores the legal system's recognition of the multifaceted impact of domestic violence and its commitment to ensuring justice and support for survivors. The court's decision reflects a broader understanding of abuse beyond physical injuries, acknowledging economic, mental, and emotional harm as well. With both parties being well-educated and socially prominent, the court noted that such acts of violence significantly affect the victim's self-worth and social standing.
The Bombay High Court's ruling sets a precedent in addressing domestic violence cases with a comprehensive view of compensation. It highlights the importance of considering the victim's suffering in its entirety while determining suitable reparations. This case serves as a critical reminder of the legal protections available to individuals subjected to domestic abuse and reinforces the judiciary's role in upholding justice for aggrieved parties.
