Banned Garmin InReach GPS Device Lands Scottish Hiker in Trouble at Delhi Airport

Garmin, renowned for its sports tracking devices, has found itself at the heart of legal issues in India, affecting international travelers. Recent incidents revealed that foreign nationals carrying certain Garmin devices were detained at Indian airports. Specifically, a Canadian and a Scottish national faced detainment in separate occurrences over the last month due to their possession of Garmin equipment.

The issue came to light when a Scottish hiker, known on Instagram as 'Hiker Heather’, reported her detainment at Delhi Airport for carrying a Garmin inReach device. She highlighted the situation through an Instagram story, cautioning others about the legal risks of bringing such satellite communicators to India. Heather narrated, "I was eventually told that the Garmin was illegal here and that they were handing me over to the Police, I called the Embassy whilst waiting for the Police and I await their further guidance, however, they are not able to intervene with legal proceedings."

It is crucial to note that not all Garmin devices are prohibited in India. The devices that do not feature satellite communication technologies are permissible for use. However, Garmin inReach GPS devices, which offer global coverage through the Iridium satellite network, require authorization for legal use in India. In a separate incident, a foreign national was detained for possessing a Garmin Edge 540, a GPS-enabled device designed for cycling, underscoring the legal implications of using devices with built-in satellite transmitters in the country.

The Indian government's stance on satellite communication devices is clear. According to the Indian Wireless Telegraphy Act of 1933, possession of wireless telegraphy apparatus without a license is illegal. This regulation extends to devices with integrated satellite transmitters, as their use violates the Act. The Embassy of India in The Hague further clarified, "Prohibition on use of satellite phones in India Travellers to India are advised that use/carrying of satellite phone by foreign nationals (irrespective of category of passport) without prior approval is illegal/ unauthorized. Satellite phone of travellers who carry them without permission will be seized and the holder prosecuted under Indian laws. Travellers are, therefore, advised not to carry satellite phones to India without prior permission."

This legal framework mandates prior permission or a Registration Code from the government for the authorised use or activation of satellite communication devices in India. Garmin's website also indicates that such devices are regulated or banned in some countries, including India. Therefore, individuals looking to purchase Garmin devices for their fitness or sports activities should ensure they do not operate on satellite communication technologies to avoid legal troubles.
