Ariha Shah Case: German Court Denies Custody Pleas of Indian Parents
In a recent development, a court in Berlin's Pankow district has rejected the custody claim of Ariha Shah, a 28-month-old Indian girl, by her biological parents.
Instead, custody has been granted to Germany's Youth Welfare Office (Jugendamt), who has been caring for Ariha since September 2021 when she was only seven months old.

According to India Today report, the local court's decision on Friday dismissed the parents' argument that their child's injury was accidental. The court justified its ruling by stating that the "best interests of the child are at risk."
Ariha's parents have expressed their trust in the Indian government and have faith that Prime Minister Narendra Modi and Minister of External Affairs Dr. Jaishankar will take steps to bring Ariha back to India. "From today, we hand over Ariha to 1.4 billion Indians," they said, as reported.
The German authorities initially took custody of Ariha Shah in September 2021, alleging that her parents, Dhara and Bhavesh Shah, subjected her to harassment. The case has drawn the attention of the Ministry of External Affairs, which has been involved since 2022.
In recent weeks, India has urged Germany to repatriate Ariha as soon as possible. The child has been in foster care in Berlin for over 20 months. The Indian government emphasised the importance of Ariha being in her linguistic, religious, cultural, and social environment, as stated in a report by PTI.
Arindam Bagchi, the spokesperson for the Ministry of External Affairs, expressed deep concern over Ariha's continued stay in German foster care and the infringement of her social, cultural, and linguistic rights.
The case has gained significant public attention in India, leading to 59 Members of Parliament from 19 political parties signing a joint letter addressed to Philipp Ackerman, the German ambassador in New Delhi.
