'Are You Well?' Delhi HC Slams Petitioner Who Sought PM Modi's Disqualification

The Delhi High Court on Wednesday slammed a petitioner who sought disqualification of Prime Minister Narendra Modi from contesting elections, as per Live Law.

The court noted that the petitioner requires medical assistance and directed local authorities to monitor him. It also instructed them to invoke provisions under the Mental Healthcare Act if necessary.

The court rejected Captain Deepak Kumar's appeal against a single judge's ruling that dismissed his plea to disqualify Prime Minister Narendra Modi, Home Minister Amit Shah, and Union Minister Jyotiraditya Scindia. Kumar alleged that all three had taken false oaths.

The bench questioned Kumar's petition, remarking, "Are you well? Your petition lacks coherence. It shifts from allegations of false oaths to claims of personal attacks, including the disappearance of your daughter and an alleged plot involving a former Chief Justice of India trying to harm you."

The court further said: "No human being can understand your petition. It makes no sense. The single judge was absolutely correct that the petition contains unsubstantiated allegations."

The court added that Kumar's allegations are unfounded and lack specific details and highlighted that Kumar had filed a request with the Central Information Commission (CIC) regarding Air India, which was rejected.

While affirming the single judge's decision, the court stated that if Kumar is not experiencing hallucinations, he should seek medical assistance. Despite Kumar asserting that he is in good health and does not require medical intervention, the bench issued the following directive:

"However, keeping in view the provisions of the Mental Healthcare Act, this court directs the local SHO, SDM and District Judge to keep a watch on the appellant and if necessary, exercise discretionary powers, whether individually or collectively, under the Act."
