High Court Reverses Govt Decision on DSP's Compulsory Retirement
The Allahabad High Court recently overturned a 2019 decision by the Uttar Pradesh state government that led to the compulsory retirement of a deputy superintendent of police (DSP), Ratan Kumar Yadav. The court's ruling highlighted a lack of proper evaluation and consideration of Yadav's service record by the screening committee, which recommended his retirement to purportedly uphold efficiency within the state police service.

Justice Prakash Padia, presiding over the case, pointed out the screening committee's failure to provide a subjective assessment of Yadav's performance. Instead, the committee vaguely justified his compulsory retirement without delving into his individual service details. This oversight, according to Justice Padia, rendered the state government's order unsustainable and contrary to law.
The high court's directive now requires the state government to facilitate Yadav's reinstatement within three weeks, effectively nullifying the 2019 order for his compulsory retirement. This decision underscores the necessity for due process and individual case review in decisions affecting the careers of government servants.
Yadav's journey within the Uttar Pradesh Police saw him rise from the rank of sub-inspector to inspector before attaining the position of DSP. His career trajectory was abruptly interrupted by the screening committee's 2019 report, which suggested his removal from service in the public interest without a thorough examination of his service record or past performances.
The court also noted that the order for Yadav's compulsory retirement included references to previous disciplinary actions, implying a form of double punishment and casting an unwarranted stigma on him. This aspect of the ruling emphasizes the court's stance against punitive measures that lack a solid basis in individual service assessment.
This judgement not only reinstates Ratan Kumar Yadav but also sets a significant legal precedent regarding the treatment of government employees. It highlights the importance of transparent and fair evaluation processes in decisions related to compulsory retirements and dismissals within public services.
