Ex-IPS Officer Not Knowing The Legal Procedure Is Shocking, Petrol Filled Bottle Is Not Molotov Cocktail

The Governor Vs DMK seems to be a never ending controversy because of the Governor's criticism of the Dravidian model of government to be an outdated theory. Meanwhile, the petrol bomb blast incident outside the compound wall of the Governor's residence has caused a brand new whirl in the Governor-DMK relationship.

Following the bomb blast, the Governor issued a series of statements in this regard which was criticised by CM Stalin in a press meet in Madurai. CM's accusation is that the Governor's residence has turned into a political party office. DMK spokesperson and lawyer Saravanan answers to the accusations of the Governor about not filing FIR and arresting the person without proper investigation or questioning.

Clarification by DMK spokesperson Saravanan:

The petrol bomb also called as Molotov cocktail is prepared by filling petrol in a bottle and covering the mouth with a cloth. The cloth will be set on fire while throwing the bomb which will explode after falling on the ground. If the cloth is not ignited properly, then the bomb will not explode.

With this understanding, it is important to know that the Governor's residence was not attacked with a Molotov cocktail, it was just a bottle filled with petrol which never exploded. After the incident, Tamil Nadu police acted quickly and arrested the person. Governor is not satisfied with the process because there was no time for him to do politics with it.

If the police had not captured the person involved with the incident, then the Governor would have stirred up panic by spreading the fear of infiltration of terrorists. Either way the Governor would have created problems because being a BJP supporter he doesn't like the growth of Tamil Nadu under Stalin's government.

Stalin's growth as a national leader; his role in materialising the INDIA alliance; his insistence on conducting caste-wise census to redress the grievances in reservation; his Dravidian model government's objective to establish social justice are some qualities disliked by the BJP party among others.

This is the reason why BJP is making so many allegations on DMK, petrol bottle incident in Governor's residence also reflects this mentality of BJP. Initially, the Governor accused the police for not taking his complaint and filing FIR.

Even a law student knows that only one FIR can be filed with respect to an event. If any other person files a complaint about the same event without the knowledge of FIR registration, the complaint will be received and the complainant will be considered as witness to the event as per legal procedure.

Then, the Governor accused the police for not taking action which is a mendacious statement because the police arrested the person involved in the event. The next allegation by the Governor is the improper investigation by police by putting the person in jail instantly.

According to law, if a person is arrested for committing a crime, he/she should be imprisoned within 24 hours. Police are not allowed to either disclose the investigation details of a crime or comment on it. After thorough investigation, the duty of police is to imprison the person who has committed the crime. This sums up to the fact that both the allegations of the Governor are false.

According to law, during the first 15 days of investigation, police have the power to take the accused outside for questioning. Usually, police conduct a field survey searching for motives before taking the accused out for questioning. Without the knowledge of motive or cause, there is no point in questioning the accused. Tamil Nadu police followed this procedure in this case also. The DGP of Tamil Nadu issued a statement clarifying the entire situation.

Karukka Vinoth, the accused who was arrested in the petrol bomb case was previously bailed out by BJP as per the DMK IT wing. As DMK exposed this particular information, BJP started spreading rumours about DMK. In the past 2 years, there have been many instances where BJP members have thrown petrol bombs at their own houses.

"Compare the information of the bomb blast outside the compound wall of the Governor's residence and the bomb blast staged by BJP members in their own houses, truth is inevitable. It is unfair to preach about law and order when the BJP party itself consists of hooligans", said Saravanan.
