What Are The Legal Options For Darshan In Renuka Swamy Murder Case?

Kannada actor Darshan, who was in police custody for 12 days in connection with the Renuka Swamy murder case, has been sent to judicial custody. He has been shifted to Parappana Agrahara central jail in Bengaluru.

This is not the first time Darshan has been behind bars. He was earlier jailed for 28 days in 2011 for assaulting his wife Vijayalakshmi and was later granted bail by the High Court.

What Are The Legal Options For Darshan In Renuka Swamy Murder Case

The state government has taken a firm decision to conduct a transparent investigation into the case. The Chief minister has instructed the minister not to pressurise anyone in the case, and the police is collecting evidence and presenting a competent argument in court.

So, what legal options does Darshan have next?

  • Apply to High Court for FIR Quashing: Darshan can file an application to quash the FIR, challenging the validity of the charges against him.
  • Seek Bail in Sessions Court: Darshan can apply for bail in the Sessions Court, which can be denied if the court feels he is a flight risk or may tamper with evidence.
  • Approach High Court if Bail is Denied: If bail is denied in the Sessions Court, Darshan can approach the High Court for relief.
  • Negotiate with Deceased Family: Darshan can try to persuade Renuka Swamy's family to withdraw their complaint or reduce the charges against him.
  • Apply to Change Accused Status: As he is not the main accused, Darshan can try to get his name removed from the FIR or claim that he was not involved in the murder.
  • Delay Charge Sheet Filing: The police has three months to file the charge sheet, but Darshan can try to delay it by putting pressure on the police or arguing that more investigation is needed.

Four accused, including Darshan, were produced in court and remanded to judicial custody for 14 days. Actor Vinay, Pradosh, and Dhanraj were also part of the accused. The judge asked if they faced any problems during their police custody, and they replied that there were no issues. SPP Prasanna Kumar argued on behalf of the state government, and Praveen Thimmaiah has taken over as Darshan's new advocate after Ranganath Reddy stepped down.
