Govt directs govt to secure records on appointment of SPP

Bangalore, Feb 22 (PTI) Karnataka High Court today directedthe government to secure all records pertaining to theappointment of Special Public Prosecutor to representLokayukta police, in a writ petition filed by a BJP citycorporator and another, challenging the appointment.

When the petitions by corporator Katta Jagadish, son offormer Minister Katta Subramnaya Naidu and Muninarayanappa,Special Land Acquisition Officer, who were caught by Lokyuktapolice for their alleged involvement in Karnataka IndustrialArea Development Board (KIADB) scam,came up for hearing beforeJustice B S Patil, he directed the government to secure allrecords regarding appointment of senior advocate B V Acharyaas SPP in the case.

As regards Muninarayanappa, Justice Patil directed thegovernment "not to precipitate the matter". He stated that hewould examine all the records and adjourned hearing of thepetitions to March 28.

Earlier counsels for the petitioners, C V Nagesh and RaviB Naik citing Apex court judgements contended that whenalready an SPP has been appointed for the Lokayukta police,the provision under 24 subclause 8 of the CrPC does notprovide for the appointment of a second PP.

The investigation into the FIRs against Jagadish andMuninarayanappa who are on conditional bail, was stayedby the High Court.
