Court quashes congnizance of a complaint against RCA officials

Jaipur, Feb 21 (PTI) A local court today quashedcognizance taken by the CJM of a complaint against RajasthanCricket Association officials for allegedly taking services ofan unlicensed private security firm at SMS stadium during ODIand IPL matches held at the venue last year.

In his order, Additional District and Sessions JudgeP S Tomar observed, "RCA officials have been wrongly ropedin... as the Private Security Services (Regulation) Act, 2005provides for action to be taken only against the serviceproviders who violate the provision of the Act and not againstthe persons utilizing the services of such agencies.

"The order of cognizance on police Complaint againstthe RCA officials dated May 28, 2010 passed by the ChiefJudicial Magistrate, Jaipur City is hereby quashed and thematter is remanded back for fresh consideration in light ofthe observation made by this Court," the order said.

The CJM had taken congnizance of a police complaintalleging that RCA Secretary Sanjay Dixit, Joint Secretary JaiPrakash Soni and others took the service of an unlicensedprivate security agency at SMS stadium during India versusSouth Africa ODI held on February 21 last year as also duringthe last three IPL games held on 7, 11 and 14 April, 2010.

It was alleged by the Police in its complaint againstRCA officials that they deliberately put security of SMSstadium at risk by engaging a security agency which was nothaving the licence to work in Jaipur.
