Retd Brigadier fined for filing ''unnecessary'' litigation

Mohali, Feb 18 (PTI) A consumer forum here has fined aretired Brigadier for filing "unnecessary" litigation againsta private hospital and one of its doctor for alleged medicalnegligence during a surgery on him.

Dismissing the complaint filed by Brigadier (retd) A CPrem, the Mohali District Consumer Disputes Redressal Forumyesterday slapped a fine of Rs 45,000 on him.

The Forum held, "This is an unnecessary litigationresorted to by the complainant. He fails to prove even an iotaof medical negligence on the part of Fortis Hospital and Dr NC Raina (the doctor accused of negligence)."

The forum, headed by its president B S Mehandiratta,ordered the ex-serviceman to pay Rs 10,000 to Fortis Hospital,Rs 25,000 to Raina and deposit Rs 10,000 with the legal-aidaccount of the forum for wasting its valuable time.

The Brigadier in his complaint had alleged his lifestylewas seriously affected for six months after he underwent afemur surgery at the hospital. He also claimed some side-effects continued even after the six months.
