Delhi HC seeks NDMC response on alleged building law violation

New Delhi, Feb 2 (PTI) The Delhi High Court today soughtan affidavit from the New Delhi Municipal Council (NDMC) aboutits sanction for construction of extra floors in some premisesin posh Jor Bagh area in South Delhi on an allegation that theCouncil had violated the Delhi Master Plan, 2021.

A division bench of Chief Justice Dipak Misra and JusticeSanjiv Khanna asked the NDMC counsel to file an affidavit withdetails about its sanction to eight premises for extension offloors.

The Bench was hearing a PIL accusing the Council ofviolating the building bylaws and Delhi Master Plan whileallowing some builders to construction the houses.

The petitioner, a resident of the area, said that in 2007the Supreme Court had permitted the construction of extrafloors subject to certain conditions and in compliance withthe Masterplan.

According to the petitioner, for every 100 square metreof built-up area parking for one car should be provided and ona plot area of 75 square yard parking space for 10 cars shouldbe provided to the residents. However, in violation of all thenorms of Masterplan and building byelaws, NDMC has grantedsanction for the huge benefit of some builders.

The genuine residents were deprived of getting the spacefor car parking in the area, said the petitioner alleging thatNDMC officials were in connivance with the builders.
