Srinagar 24 Jun (UNI) Close on the heels of filing of a criminal case against the Chief Executive Officer (CEO) of Shri Amarnath Shrine Board (SASB) Dr Arun Kumar, the Peoples Democratic Party (PDP) filed a breach of privilege motion in the Legislative Council against him.

The Jammu and Kashmir government has already constituted a three- member committee to go through the records of Dr Kumar's press conference in which he had reportedly criticsed the cabinet and some minister in land transfer to SASB case.

A spokesman of the PDP said two members of Legislative Council (LC) Murtaza Khan and Basharat Bukhari today filed a breach of privilege motion before the Chairman Legislative Council against Dr Kumar for using words and language that amounts to undermining the authority and constitutional position of the Legislature of Jammu and Kashmir.

He said the move was apparently initiated against Dr Kumar on objectionable remarks made by him during a press conference on June 18, 2008 at Raj Bhawan.

The privilege motion has taken evidence from Dr Kumar's remarks challenging the authority of Legislature by saying the Governor heads the state legislature and that they ( Raj Bhawan) have to see if the legislature has the power to issue recommendations to the governor and the shrine board.

They said Arun Kumar is a public servant and is holding a position that has been created by an Act of the Legislature. His remarks tend to undermine the authority of the Legislature and attract punitive jurisdiction of both Houses of Legislature.

The PDP has also filed a criminal case against Dr Kumar in the court of Chief Judicial Magistrate (CJM) who has directed Senior Superintendent of Police (SSP) to investigate and inquire the allegations against Dr Kumar.

The judge directed the SSP, Srinagar to investigate all the allegation leveled against Dr Kumar and report within 15 days.

The CJM has listed the case for July 5.
