Construction of third floor permissible only in residential areas:SC
New Delhi, Apr 28 (UNI) The Supreme Court today clarified that its order dated March 14 permitting construction of third floor is confined only to residential areas in Delhi and its construction in commercial areas has not been permitted.
A bench comprising Justices Arijit Pasayat and P Sathasivam clarified the position when it was brought to the notice of the court by amicus curiae senior counsel Ranjit Kumar that there was some confusion amongst MCD officials regarding the order of this court dated March 14,2008.
The court remarked, ''Everything is clear in our order which clearly states that third floor is permitted only in residential areas as per Master Plan Delhi 2021.'' Justice Pasayat also remarked in lighter vein, ''Your officers can act according to the suitcase which suits them.'' With today's order it is clear that owners of properties in commercial areas of Delhi cannot raise third floor.
