HC dismisses modification petition of Woodlands Hotels
Chennai, Apr 22 (UNI) Madras High Court today dismissed a modification petition filed by Drive-in Woodlands Hotels here.
A Division Bench, comprising Mr Justice Elipe Dharma Rao and Mr Justice M Venugopal, while dismissing the petitions, observed that ''there is no lease agreement between the petitioner and the Tamil Nadu Government. Hence, the petitioner could not claim any right on the government land.
The hotels' management had filed a petition as a third party to the proceedings, praying to grant leave for them to seek a review of the common judgement passed by the court on April 11, upholding the Government Order cancelling the land lease to Agri and Horticultural Society.
The bench also observed that the petitioner was an unauthorised occupant of the land. The Society had granted lease in favour of the hotel only for an extent of eight grounds and 1,390 sq ft and it was not known how the petitioner could claim to have been in possession of 20 grounds of land and this fact has not been explained by the petitioner, it observed.
