Expansion of Raje's council violation of Constitution: Cong MLA

Jaipur, Jan 10 (UNI) Congress sitting MLA Sanyam Lodha has urged Governor Shilendra Kumar Singh to cancel appointment of five Ministers and/or Parliamentary Secretaries who have been appointed allegedly in violation of the Article 164(1A) which restricts the size of the ministry to 15 per cent of the total strength of the State Assembly.

Mr Lodha told reporters here today that recent expansion of the Vasundhara Raje Council of Ministers was in violation of the article 164(1A) inserted in the Constitution through 91st amendment in 2003.

According to the provisions of the above article, the council of ministers can have ministers to a ceiling of 15 per cent of the total strength of the state assembly.

He said Parliamentary Secretaries also fell into category of Ministers as defined in the rules of procedure and conduct of business in the state assembly.

Mr Lodha said he had today sent a memmorandum to the Governor seeking his intervention and an immediate appropriate action for the cancellation of the appointments of ministers who exceeded the ceiling.
