Court quashes person's detention in anti-national activities
Jammu, Jan 4 (UNI) The Jammu and Kashmir High Court, Jammu Wing, today quashed the detention of a person in the anti-national activities under the Public Safety Act (PSA).
Mohd Yaqoob was detained following an order by the District Magistrate on the ground that in the event of his release on bail or otherwise, he was likely to revive his anti-national activities in future.
Justice J P Singh observed the detention indicated the petitioner was in police custody when the District Magistrate had issued the detention order. He said the detention would pose a serious threat to the security of the state.
The court observed: ''Before detaining a person, who is already in custody, the detaining authority is required to spell out the reasons.'' The HC allowed the Habeas Corpus petition and quashed the detention order passed by the DM, which was found to be ''unwarranted and illegal''. It further ruled that the petitioner be set at liberty forthwith if not required in any other case.
