HC summons to Hotel Hans Plaza for using T-Series Songs
New Delhi, Dec 22 (UNI) The Delhi High Court issued summons to Hotel Hans Plaza in Delhi for playing T-Series songs on their cable network without the prior approval or obtaining the requisite licence from the music company.
Justice Aruna Suresh issued the summons last week and asked the respondents to present themselves before the Joint Registrar of the Delhi High Court on April 8, 2008 to settle the issues of licence fees. The court directed Hotel Hans to restrain from playing the songs till then.
Praveen Anand and Ameet Dutta, lawyers for the Music Company, alleged that the hotel had an internal cable television network which operated from Delhi. The hotel authorities had been using the audio and video material of T-Series without obtaining the requisite licence.
T-Series have a scheme in respect of usage of their copyrighted material known as T-Series Public Performance Licence (TPPL Scheme) and the cable operators and television broadcasters can obtain the permission from them. But the hotel had been continously using T-Series songs without obtaining the licence.
The company on three earlier occasions had asked the hotel to obtain the licence but the latter failed to do so.
