Chennai, Dec 5 (UNI) 'Maxim' magazine official Fazal Hussain Khan, an accused in a case filed by actor Kushboo for publishing her photo in the magazine without her consent, today filed a writ petition in the Madras High Court seeking to quash the FIR lodged against him.

Admitting the petition, Justice K N Basha stayed all proceedings against Mr Khan for two weeks and issued notice to the prosecution, returnable in two weeks.

He also dispensed with the personal appearance of Mr Khan in the trial court.

In his petition, Mr Khan submitted that he was only the regional circulation manager of South India and was not associated with the publication as the magazine was published in London. The complainant had wrongly included his name in the case, he contended.
