Court directs to remove fifth floor in the Capital

New Delhi, Nov 16 (UNI) Delhi High Court today directed the MCD to take stern action against all illegal constructions in the city, especially those raised up to fifth floor.

A special bench comprising Justices A K Sikri and Rekha Sharma directed the MCD to remove or seal all unauthorised constructions in the Capital. The court stated that all buildings in which fifth floor has been constructed without a sanction plan are illegal and the extra floor should be demolished.

The master Plan 2021 also does not allow construction of the fifth floor, the bench noted.

The court asked the Monitering Committee, headed by Mr B L Vohra, to take all steps to ensure that all illegal constructions in the city are removed.

Earlier MCD had sought one-year time to suspend the demolition activities in the capital, as per the Delhi Special Provision Act 2006. The demolitions were suspended from May 18,2006 to May 17,2007.

The Court has now asked the Committee to continue monitering the demolitions of illegal constructions in the city.
