Tribal, sentenced to death, acquitted on appeal

Baripada, Nov 5 (UNI) A 27-year old tribal youth, sentenced to death in a murder case by the Baripada Additional Sessions Judge of the Fast Track Court (FTC), was released from the Baripada Circle Jail by an order of Orissa High Court.

Charan Ho, a suspected ''witch-killer'', who had been convicted under the IPC's Section 302, escaped the gallows in a ''Jail Appeal'' case on November three.

Charan had walked into the Baripada Jail on transfer from Udala Sub-Jail on April 29.

However, the next day, the Jail authorities urged him to appeal further and he promptly agreed.

Later, Superintendent of the Baripada Circle Jail Sibdas Chand got a prescribed application form, signed by Charan Ho, for legal aid to appeal before the High Court.

The application for ''Jail appeal'', perhaps the first ''Jail Appeal Case'' from the Baripada Circle Jail, was sent to the Registrar of the High Court on April 30.

Orissa High Court acquitted him, stating that ''he is entitled to benefit of doubt.'' The Additional Sessions Judge (FTC) had awarded capital punishment to Charan Ho at his Udla camp court on April 26.

According to the prosecution, Charan Ho, of Gadidhar village under Khunta police station in Mayurbhanj district, had killed two suspected ''witches''.
