New Delhi, Oct 10 (UNI) The Supreme Court today directed Union Home Secretary Madhukar Gupta and Solicitor General G E Vahanvati to appear before the court on October 22 and explain why a counter affidavit had not been filed against a PIL seeking release of lifers who had completed 14 years in jail.
A Bench, comprising Justice H K Sema, Justice Lokeshwar Singh Panta and Justice D K Jain, issued the order when informed by the petitioners that the Centre had not filed its response despite the final opportunity being granted to them by this court.
A petition filed by Mr M K Balakrishnan had sought directions to the Centre, states and Union Territories to review the cases of convicts who had been sentenced to life imprisonment and had completed 14 years in jail but their release depended on their conduct during their stay in jail.
However, another petition filed by Mr Anil Sharma had challenged the decision of the then Om Prakash Chautala Government in Haryana ordering premature release of convicts who had not even completed 14 years in jail.
The court will hear the batch of petitions on October 22.
