HC stays by-election to ward no. 76 of BMC

Mumbai, Sep 17 (UNI) The Bombay High Court today stayed election to ward No 76 of the Brihanmumbai Municipal Corporation.

A division bench comprising justices S B Mhase and D G Karnik intervened in the matter, even though election process has been started, and stayed the by-election to the ward.

Jagdish Kuttiyani, a second contestant from the ward, had moved the High Court, objecting to the elections saying that he has filed election petition against the ousted corporator Subhash Sawant, seeking to declare himself as winning candidate.

He contended that his election petition would become infructuous if the elections were allowed to take place.

The High Court has also directed the lower court, where the election petition is pending, to decide the matter within three months.
