HC stays demolition of extra construction in Navbharat Apartments

New Delhi, Sept 11 (UNI) The Delhi High Court today issued an interim stay on the demolition of certain extra portions build in Navbharat Apartments at Paschim Vihar.

Justice Geeta Mittal directed DDA, MCD to stop the demolition action till February 2, 2008, the next date of hearing.

DDA, on September 22, 2006 issued an order to demolish the extra constructions added to the flats, mainly the verandahs and balconies.

The Residents Welfare Association(RWA) of the Navbharat Apartments approached the court to request the Lieutenant Governor of Delhi to set aside the DDA order.

The RWA members submitted that they have constructed 148 flats instead of 150 which was duly sanctioned by DDA. They said no construction in the flats was beyond the permissable limit.

Flat owners have covered the verandahs and balconies, but no extra construction was done. This, was within permissable limits of DDA norms, they added in their submission.

The court directed DDA to halt the demolition action till the case's next date of hearing.
