New Delhi, Sep 10 (UNI) The Supreme Court today granted six weeks time to the Central Bureau of Investigation (CBI) to file its response to a petition alleging that Congress Lok Sabha Member from Tezpur in Assam M K Subba is an absconder from Nepal, where he was serving sentence in a murder case.

A bench comprising Chief Justice K G Balakrishnan and Justices R V Raveendran and D K Jain granted time to the CBI after its counsel sought time for completing the investigation to establish the identity of the Congress MP, who is considered to be 'the lottery king' of Northeast India.

According to the petitioner Birendra Nath Singh, the real name of Subba is Limbo and he has changed his identity and entered India through Sikkim. His nationality could not be established till date and he has changed his name to conceal his real identity.

Earlier, the CBI had submitted a report in the Supreme Court that it was not in a position to establish the identity of M K Subba.

The court had reprimanded the CBI for not conducting free and fair investigation into the allegation against the Congress MP.

The CBI had failed to collect any evidence to show that either Subba was born in India or he had studied here. There is also no evidence to show that his parents were ever citizens of this country.

Even today the court was dissatisfied with the way the CBI was conducting the investigation into the matter.
