HC grants bail to man instrumental in miscarriage of his wife

New Delhi, Sept 8 (UNI) The Delhi High Court has suspended the sentence of a man who was convicted by a lower court for being instrumental in causing the miscarriage of his wife.

Justice Reva Khetrapal last week suspended the sentence of Rajesh Bhardwaj, who was sentenced to 10 years in prison for offences under sections 313/314 of the Indian Penal Code.

The court ruled that the Rajesh's wife Poonam had a marital dispute with her husband under sections 498-A, 406,and 506 of IPC.

The cases were registerd in Bahadurgarh, Haryana, and the present case was registered in New Delhi five months later.

The court observed that Poonam's father was a senior Delhi Police officer and used his clout to get a case registered against Rajesh.

Poonam had registered a case against her husband and mother-in-law alleging that they were instrumental in causing her miscarriage.

According to Poonam, her husband had made her take a tablet on the night of December 5, 2002 and again a pill was given to her after two day by her mother-in-law, which caused severe bleeding resulting in miscarriage .

Though the lower court acquitted the mother-in-law, it held the husband guilty for causing the death of the foetus.

The court suspended the sentence of Rajesh till the pendency of the appeal and granted him bail on furnishing a personal bond of Rs 25,000 and two sureties of like amount.
