Body remains to be handed over to family after 6 months of murder
Mumbai, Sep 3 (UNI) A Sessions court today directed police to hand over the body parts of a person whose body was exhumed after six months of murder on the basis of information provided by the accused to his family.
The court's directive came after the pronouncement of a life sentence to Irfan Safiullah Sheikh for the murder of Kamaluddin, alias Barry.
While passing the judgement here, Additional Sessions Court Judge P T Chaware said, ''On the basis of the post-mortem report of Kamaluddin's skeleton, Sheikh is found guilty under Sections 302 and 397 of the Indian Penal Code (IPC).'' Accused Sheikh will have to undergo life imprisonment and pay a fine of Rs 3,000. In case of default, he will have to undergo an additional sentence of six months.
Additional Public Prosecutor N R Rathod said, ''In April 2005, the accused had killed Kamaluddin at his residence at Sathe Nagar in Deonar of the eastern suburbs and buried the body in the house itself. Thereafter, he robbed cash worth Rs 1.85 lakh from Kamaluddin's cupboard and fled away.'' On October six, Sheikh confessed that he had killed Kamaluddin and buried the body in his house. Police recovered Kamaluddin's skeleton from the site. On scientific examination of the body parts, it was proved that the bones belonged to Kamaluddin.
Mr Rathod further said there was no eyewitness in the case and all other witnesses had turned hostile. Only on the basis of the post-mortem report, the court convicted Sheikh to life imprisonment.
