SC to consider tomorrow Centre, MCD application on sealing

New Delhi, Aug 26 (UNI) The Supreme Court will consider tomorrow the applications filed by the Centre and MCD seeking to defer the sealing of commercial premises operating from 1500 unauthorised colonies spread all over Delhi awaiting regularisation by the government.

A bench headed by Justice Arijit Pasayat has already warned MCD respondents including MCD to be ready to face contempt of court proceedings if it is proved that the orders of the court on sealing of illegal commercial premises operating from residential areas have not been complied with.

The apex court had earlier directed MCD to seal all comercial premises not protected by MPD (Master Plan Delhi) 2021.

The court will also consider the report of the monitoring commitee appointed by the Supreme Court which has already brought to the notice of the court that the orders and the direction of the apex court are not being carried out by MCD and hence MCD is liable to face contempt of court action.

The Centre and MCD are seeking to defer the sealing pleading that the process of regularising unauthorised colonies having a population of over 40 lakhs is in the final stages and Delhi government is going to finalise the list soon.

Earler the court had threatened to stay MPD 2021 till basic infrastructure including basic amenities such as water, electricity, parking space and roads etc are not provided by the government to make the new master plan workable, as it seeks to regularise almost all illegal and unauthorized constructions as well as encroachments on public and private lands which include slums and JJ clusters.
