SC issues notice to the K'taka High Court on an employee's petition

New Delhi, Aug 24 (UNI) The Supreme Court today issued notice to the Chief Justice of Karnataka High Court, on a petition filed by a dismissed employee of the High Court seeking directions to the Chief Justice of the High Court not to hear his case.

Mr K Sippe Gouda, a trade union leader and former president of Karnataka State Government Employee's Association, who was working as a court officer in the state High Court was dismissed from service for not complying with the administrative orders of his superiors.

The petitioner contended before the bench comprising Chief Justice KG Balakrishnan and Justices Tarun Chatterjee and RV Raveendran that since it was the order of the Chief Justice of the High Court, dismissing him from service passed on by the administrative side, it would not be proper for the Chief Justice of the same court to hear his case.

Mr Gouda was issued memo by the registrar (judicial) of the High Court on December 18, 2004 seeking an explanation as to why he did not ply with the orders of the Chief Justice of the High Court asking him to report for duty in court hall number one.

The petitioner has also contended that his petition should be heard by a single judge and not by the division bench unless and until specific direction have been issued.

The apex court however refused to issue any interim, directions to the High Court not to list the matter before the court of the Chief Justice of the High Court.
