A two-judge bench, comprising Justice Amit Talukdar and Justice A K Bhattacharyya, issued the ruling on a petition of state Criminal Investigation Department stating some legal hurdles in rearresting the two.

Earlier the high court also issued a ruling to arrest the two accused after the prosecution and a suriving memeber of the Pal family filed a petition seeking retrial of the case.

In its petition the CID told the court that Lakshmi Narayan Chakraborty and Chandan Das who were acquitted by a lower court for lack of evidence about two months ago were at large.

The high court should issue a non bailable arrest warrant to put the accused behind the bars, it stated.

Chakraborty and Das were charged with poisoning a family of four at Oxytown in southern part of the city about a decade ago.

Chakraborty used to give tuitions to a daughter of the family who also died of poisoning.
