Patna, Aug 22 (UNI) Bihar Congress today demanded resignation of Deputy Chief Minister Sushil Kumar Modi in the wake of arrest warrant against him by a Jharkhand court for alleged violation of model code of conduct during campaigning in 1998 Lok Sabha election.

Chief spokesman of Bihar Pradesh Congress Committee (BPCC) Prem Chandra Mishra said Mr Modi should resign as he would have to surrender before the court following issuance of warrant against him.

It would be in contravention of the Constitutional decorum if Mr Modi surrendered before the court as Deputy Chief Minister of a state, he added.

'' Chief Minister Nitish Kumar should sack him if he does not resign on his own, '' the Congress leader demanded.

Earlier during the day, a local court of Latehar in Jharkhand had issued warrant of arrest against Mr Modi following his failure to appear before it despite issuance of several summons against him in connection with his alleged violation of model code of conduct during campaigning in Lok Sabha election, 1998.
