Sanjay Dutt may be back in jail after a few days

Mumbai, Aug 20 (UNI) Interim bail granted to actor Sanjay Dutt and five other convicts in the 1993 serial blasts case by the Supreme Court might be short-lived and they all would be back in jail soon, legal experts opined.

The other convicts are Azid Ahmed, Zaibunnisa Anwar Kazi, Ibrahim Musa Chauhan alias Baba, Yusuf Nulwalla and Samir Hingora.

Granting interim bail to the convicts, the apex court, in its order, today stated that the bail is for a limited period till the time the designated court supplies them with a copy of the detailed order of the conviction, legal experts who appeared in 1993 blast case, told UNI here today.

According to Advocate Subhash Kanse, as per the order of the apex court they have to surrender after they receive the copy of the designated court. The convicts would then have to make a fresh application for regular bail or make an appeal against the conviction handed down to them.

He said as per the procedure, the copy of the apex court has to be first submitted to the designated court after which a surety will be taken, only after that the copy of interim bail will be send to the various jails in which the convicts have been lodged. These convicts would only then be released from jail.

Kanse said Dutt and the others were told that will be a certified copy of the TADA court order on August 27, but according to sources in the TADA court, the same copy may not be ready by August 27. Therefore, the convicts will again have to approach the Supreme Court with a fresh plea to extend their interim bail because they would not be given the certified copy on the scheduled date.

Meanwhile, Advocate Farhana Shah, who was regularly appearing for Dutt and four others in the TADA court, said she had not gone through the order of the apex court in detail, but if the condition of surrendering again has been imposed for granting of the bail in that case they would have to surrender before the TADA court once again and then make a fresh application for bail in the apex court.

She said as per the procedure, after the release of Dutt and the others they would have to appear in TADA court the next day after their release on bail for completing the formalities and furnishing the personal bond.
