HC summons IO for concealing facts
Allahabad, Aug 20 (UNI) Allahabad High Court today smmoned the investigating officer (IO) of police station, Karely, Allahabad on a writ petition filed by an associate of Samajwadi Party Member of Parliament (MP) and proclaimed absconder Atiq Ahmad.
The court summoned the IO on August 29, as he -- concealing the interim relief granted to the petitioner by the HC -- obtained an order under section 82 CrPC for attachment of the petitioner's property.
A division bench comprising Justices K S Rakhara and S K Jain passed this order on a writ petition filed by Mohd Abbas.
The petitioner has filed a writ petition seeking quashing of an FIR lodged against him at Karely police station under IPC sections 419, 420, 467 and 468.
The allegation against the petitioner was that he, after puchasing plots for the purpose of constructing 'Mak Town', had finished a canal, that pre-existed on the spot.
Petitioner's counsel S M A Kazmi, assisted by S Ahmad, pointed out that in spite of interim relief granted to the petitioner, the IO moved an application before the magistrate concerned for issuing the warrant of attachment under sections 82 and 83 CrPC concealing the pendency of writ petition and the assurance given by the government advocate.
Meanwhile, the court had stayed the operation of the attachment order of the magistrate.
