UP govt directed to maintain status quo over plots allotment

Allahabad, Aug 16 (UNI) Hearing a writ filed against the cancellation of plots allotment for the construction of five star hotels in Noida, the Allahabad High Court today directed the state government and Noida authorities to maintain status-quo over the allotment of plots.

A Bench, comprising Justices B S Chauhan and Rakesh Sharma, while passing the interim order for status-quo, also ordered the state government, Noida and other respondents to file their reply in this case by September 12, the next date of hearing.

The HC passed this order on a writ filed by ITC Limited company and seven others which stated that the government had decided to allot plots on 90 years' lease in Noida for the construction of five star, four star and three star hotels to promote tourism.

According to this policy of the government, the petitioners had been alloted plots on a lease in 2007 and they had been given possession over their allotted plots. The petitioners had also started construction work.

It was alleged in the petition that the ITC Ltd had spent Rs 24 crore for the construction work. As per as the government policy, plots were allotted for construction on May 22, 2006 at industrial rates.

The state government on August 3, 2007 had passed the impugned order, cancelling the allotment of plots. The order was passed under section 41 of the UP Urban Development Act, 1973.
