Alimony: AIMPLB to form committee to fight legal battle
Hyderabad, Aug 13 (UNI) The All India Muslim Personal Law Board is forming a committee of legal experts to file a review petition in the Supreme Court, which had recently ruled that an estranged Muslim woman could seek alimony from her husband till her remarriage or for life.
The AIMPLB was of the view that Muslim men were obliged to pay maintenance only during the iddat period, AIMPLB assistant secretary Mohammed Abdul Rahim Qureshi told reporters here today.
The Supreme Court, hearing the plea of a deserted woman, had stated that the law framed in the wake of the Shah Bano case would not come in the way of an estranged Muslim woman seeking alimony from her husband under section 125 of the CrPC, which provided for maintenance to a divorced or neglected woman.
In Muslim society, marriage was only a contract and parents and brothers take care of women separated from their husbands, he said.
