Sohrabuddin: SC order on cancellation of Amin bail on Aug 13

New Delhi, Aug 10 (UNI) The Supreme Court will pronounce its order on August 13 on the petition filed by the state of Gujarat for cancellation of anticipatory bail granted to Narender Kumar Amin, DSP Gujarat police, who is an accused in Sohrabuddin fake encounter case.

A bench, comprising Justices Tarun Chatterjee and P K Balasubramanyan reserved the order after hearing the argument on the petition.

Senior Counsel K T S Tulsi contended that Amin was required for custodial interrogation and if the Session Judge order, which is totally perverse, is not set aside then the trial in the case will get derailed, and the truth about the killing of Kausar Bi will never come out.

Counsel for Amin, L Nageshwar Rao, however, contended that his client has nothing to do with the fake encounter case and is being falsely implicated on the basis of a statement of a police driver Nathu Bhai Jadeja, who had alleged that Amin was present with the police party when the body of Kausar Bi was disposed off on November 28, 2005.

Amin has also contended that he was not involved in the offence of destruction of evidence under section 201 IPC. Kausar Bi was allegedly killed by the state police one day after the murder of her husband on November 25, 2005.

The apex court will also hear the main petition on Monday. Seven people including three senior IPS officers are already in the custody in the murder of Sohrabudduin Sheikh, who was branded by the Gujarat police as LeT militant involved in conspiracy to assassinate the state Chief Minister Narendra Modi.
