MCD scheme for regularising unauth contruction in plotted housing
New Delhi, Aug 7 (UNI) In a development which is expected to pave way for regularising residential units of lakhs of people in Delhi residing on plotted development areas, the MCD today announced implementation of the scheme for regularisation of unauthorised construction of residential premises within the plotted housing on payment of a prescribed fee.
Briefing mediapersons, MCD Standing Committee Chairman Vijender Gupta said, ''The scheme, passed by a resolution passed by the Standing Committee in its June 6 meeting, takes into consideration the difficulties being felt by the owners of the ground, first and second floors on the plotted housing areas. It is a known fact that the cost of purchase of an entire building has become prohibitive.
It is now, therefore, common practice that individuals buy the flat floorwise. With this scheme, the way has been cleared for regularisation of unauthorised construction.'' Mr Gupta said in plotted development areas where dwelling units are sold floorwise, it is not possible to regularise all floors of a building together as all owners of the building may not come forward to regularise. Keeping in view the difficulties of such house owners, MCD has come out with a scheme which would regularise their unauthorized construction on payment of additional prescribed charges.
The objective of the press conference is to call upon individual floor owners viz. owners of ground floor, first floor and second floor to comply with the revised norms and get the compoundable portion regularised on payment prescribed fees.
Addressing reporters, Deputy Chairman, Standing Committee, Yogender Chandolia said in view of a policy on the subject, lakhs of citizens residing on ground, first and second floor in plotted development areas were facing serious difficulty in getting their unauthorised construction regularised.
''Keeping in view the provisions of the Master Plan of Delhi 2021, MCD has come out with scheme for regularisation of unauthorised construction in their premises,''he said.
Mr Gupta informed that the Master Plan 2021 [PARA 4.4.3 (xiv) provides or regularisation of residential plotted housing in terms of additional coverage on payment of prescribed fees over and above betterment levied charges. In all such cases, owners of ground, first and second floors may get their individual floors regularised on payment of prescribed fees.
He clarified that the rates prescribed for regularisation would remain in force in respect of subsequent years unless specifically revised and notified with the approval of the Central Government.
The Chairman said henceforth, an application by an individual owner who has acquired ownership rights either through registered sale deed or through power of attorney be entertained. He clarified that while scrutinising such applications, benefit of excess coverage now permissible to individual owner, will be given proportionately to the existing covered area within the permissible building envelope on each floor. He added that these modalities will be applicable in respect of owners seeking regularisation of ground, first and second floors.
Mr Gupta said an Indemnity Bond will also be obtained in all cases to the effect that the Corporation shall be kept harmless in case of any dispute of the title or otherwise.
Mr Chandolia added that no regularisation in respect of third floor will be permissible as the matter is under consideration of the Supreme Court.
''The MCD will follow the directions of the court in the matter as and when they are issued,''he said.
