HC sets aside single judge order
Allahabad, Aug 1 (UNI) Allahabad High Court today kept in abeyance the judgement and order passed by a single judge of the HC, whereby it had enhanced the retirement age of the employees of Uttar Pradesh Jal Nigam (UPJN) from 58 to 60 years.
The special appeal bench of High Court passed this order on an appeal filed by the nigam through its chairman and others.
They had challenged the order of the single judge of May 21, 2007, whereby it had quashed the regulation 4 of 2005 to the extent it provides superannuation age of 58 yrs for its employees, who were directly appointed except Group D employees.
The single judge had quashed the regulation being arbitrary.
As per rules, transferred employees from local self government engineering department were absored in the Jal Nigam under section 37 of the act and these employees would superannuate at the age of 60 years.
But, other employees of the Jal Nigam would retire at the age of 58 years.
The bench comprising Justices S R Alam and V C Mishra stayed the operation of single judge order after hearing M C Chaturvedi for the nigam.
He argued that there was no pleading in the writ petition but the court had quashed regulation 4 of 2005 of the jal nigam.
