Court directs for action against Prof Jabir Hussain

Patna, July 30 (UNI) Patna High court today directed the concerned authorities to initiate move against then chairman of Bihar Legislative Council Jabir Hussain and secretary Kapil Deo Prasad if they were found guilty of the irregularities in the appointments made during their tenure in the council secreatariat.

While disposing the writ petition justice V.N.Sinha observed that "if any offence had been committed by the duo then the authorities should take up the matter in accordance with law otherwise the petitioner would be free to initiate criminal prosecution against the guilty".

Petitioner Raj Kumar Singh alleged that altogether 77 appointments were made in the first fortnight of April 2006 by the then chairman Jabir Hussain in connivance with acting secretary of the council Kapil Deo Prasad and others. It said that only 17 posts were advertised but 77 appointments were made throwing all norms into dustbin.

Meanwhile, through an affidavit the Bihar State Legislative Council informed the court that all 77 appointments had been cancelled and those appointees were terminated from the services on August 22, 2006.

The counsel representing the Bihar Legislative Council pleaded that the writ petition became 'infructous' as the selection process under challenge had already been cancelled.
