Armyman charged with contempt of court for using abusive language

New Delhi, July 26 (UNI) The Delhi High Court today charged an army jawan with contempt of court for disturbing the proceedings and using abusive language.

Justice Vikramajit Sen and Justice S L Bhayana issued notice to Ashok Kumar Sharma, an army jawan to show cause within a day as to why the contempt proceedings under the 1971 Act will not be initiated against him for disturbing the functioning of the court, using derogatory language with the intention of scandalising and lowering the authority of the court as well as obstructing the adminstration of justice.

The matter, listed for July 27, pertains to a case filed in the Court by Sharma who was reduced to a lower rank and later dismissed from service. His conduct in the court has been regularly abusive and non-cooperative.

Today again he disturbed the proceedings of the court and abused the judges.

The court observed that Sharma had been misbhaving in the court on earlier ocassions also and his conduct in the court was hostile.

In December 2006, owing to his bad behaviour, a bench comprising Justice Swatantar Kumar and Justice G S Sistani had transferred the case to some other Bench.

Similarly on January 16, 2007 Kumar misbehaved before a Bench comprising Justice T S Thakur and Justice S N Aggarwal due to which the case was transferred out of the court.

The court had said that Kumar's conduct was far from being respectful and his language was overbearing in the approach perilously close to what may amount to contempt of court.

Sharma was posted as a nursing assistant with the Indian Army in the year 1980. His greivance is that he was not promoted to the rank of Hawaldar within stipulated time due to departmental carelessness and suffered loss of prestige as well as finances in terms of allowance of Hawaldar Rank. He served the army for 16 and a half years but the officials did not take note of his letters.

Later he was dismissed.
