HC orders issuence of NBW on Karnataka Chief Secretary
Bangalore, July 16 (UNI) The Karnataka High Court today ordered issuing of a Non Bailable Warrant against Chief Secretary P B Mahishi for failing to furnish details related to illegal layout in the outskirts of the city.
Petitioner Kavitha of Balaji Layout, Kodigehalli, in her petition stated that the Municipal authorities had not taken any decision on house constructed in 1994. Nearly year after she constructed the house, Municipal authorities issued a notice stating that construction was illegal and they would demolish.
Following this Kavitha applied for regularisation by paying penalty but the CMC did not persue the case. Kavitha approached the court a few months ago and acting on the petition Justice Rammohan Reddy served a notice to the government seeking clarification.
In the reply the Under Secretary, Urban Development Department said that they have no details to about the directive a from the CMC to demolish Kavitha's house.
On June 26-2007 Justice Reddy directed Mr Mahishi to provide details. Following this his Personal Secretary filed an affidavit which was rejected by the court which ordered issuance of Non Bailable Warrant today.
