SC declines to stay order for extradition of Kohli
New Delhi, July 13: The Supreme Court today declined to stay the order of Delhi High Court clearing the decks for extradition of Maninder Pal Singh Kohli facing charges of rape and murder of a British teenager.
The Delhi High Court on July 6 had upheld the order of Additional Chief Metropolitan Magistrate, Kamani Lau who had ordered extradition of Kohli to England vide order dated June 8, 2007, for facing trial for the rape and murder of 16 year-old Hana Foster in 2003.
Kohli who was a driver in England had fled from there after committing the crime and was later apprehended in India.
The petition was mentioned before a bench comprising Chief Justice K G Balakrishnan and Mr Justice R V Raveendran for early hearing and the court fixed July 29 for hearing of the petition.
Petitioner in his appeal has contended that he is innocent and is being falsely framed and the courts below have committed a grave error by ignoring his apprehension that he will not get free and fair trial in Britain.
