New Delhi, July 13 (UNI) The Delhi High Court today issued notice to a contractor for not granting the members of a housing society the possession of their flats in Rohini.

Justice BN Chaturvedi ordered that contractor, Manohar Singh, should explain on August 24 how to facilitate the possession of the flats. About 25 members of Sandeep Co-operative Group Housing society Ltd in Sec 13, Rohini moved the High Court today.

Their counsel Vineet Bhatia argued before the judge that the petitioners fell between the society and the contractor. The former owed some money to the latter. The dispute between them, over amount, led the contractor to deny the petitioners possession of their flats.

Mr Bhatia asked the court why they should suffer for the dispute between the sparring parties. It prompted the judge to ask the society to clear its dues today.

The petitioners accused the society of entering into an agreement with the contractor, without following the due process of law and without taking them into confidence.

Besides, no policy was framed as to which and whose flats would be put under lien if at all, the petitioners further added.

The counsel also argued the petitioners continued to suffer for the last 6-7 years for no rhyme or reason. Staying in rented accommodation, most of them are bearing a double penalty while meeting the rent requirements. And besides repaying the loan taken from the banks, they need to pay the respondent society to settle the cost of the flats.
