SC refuses to stay MBBS admissions in Tamil Nadu

New Delhi, July 9 (UNI) The Supreme Court refused to stay the admission process for MBBS courses starting from today in Tamil Nadu.

A bench comprising Justices B N Agarwal and P P Naolekar, however, issued notices to the state of Tamil Nadu, Tamil Nadu Private Medical Colleges Association and the selection committee on a petition filed by a minor, S Swathe, represented by her father.

Swathe's father challenged the Madras High Court judgement upholding the decision of self-financing institutions decision to surrender 65 per cent (50 per cent in case of minority institutions) of MBBS cources to the government quota.

The petitioner, who was at serial number 177 and was sure to get admission as the total number of seats were 350, was denied admission as a result of impugned decision of self-financing medical institutions.

The petitioner had challenged the validity of the decision on the grounds that the state has no power to reduce the number of seats by arbitrarily increasing the government quota.

The court, however, ruled that the admissions made on the basis of counselling, starting from today, shall be subject to the outcome of the present petition.

The respondents have been directed to file their response within three weeks.

The government quota seats are filled up through Common Entrance Test.
