High Court allows Indians' appeal

Kolkata, Jul 06 (UNI) A two-judge Bench of Calcutta High Court today allowed an appeal of Indians against a Trial Bench ruling in favour of a flight purser, who was grounded for keeping long moustache.

Mr Joynath Fey was first grounded and then forced to retire at the age of 58 in January, 2001, two years before his schedule retirement as he refused to trim his moustache.

In August, 2002, Trial Bench judge of the High Court Alok Chakravarty directed Indians to reinstate him imediately on an appeal.

Justice Chakravarty, however, skirted the issue by not saying whether Mr Dey should resume his service as a purser or not.

The airlines moved an appeal against the order before the High Court Division bench.

A two-judge Bench, headed by Justice Asim Banerjee, allowed the appeal today.
