HC stays summons of Ansal brothers

New Delhi, July 3 (UNI) The Delhi High Court today stayed the summons of Ansal brothers and their employees accused of intimidating a victim of Uphaar Tragedy Case and issued notices to her for November 13, asking why the petition of quashing their summons be not heard.

Justice B N Chaturvedi after hearing the petitions of Deepak Katpalia and Praveen Sharma seeking quashing of their summoning orders issued by the Additional Metrpolitan Magistrate stayed their summons till November 13 and issued notices to one Neelam Krishnamurti, a victim of the Uphaar tragedy case to appear on the same date and put forth her case.

Ms Krishnamurthy, who lost her two children in the tragedy and is pursuing the case for the last ten years had approached the court alleging that she was being threatened by Sushil and Gopal Ansal and their employees particularly Katpalia and Sharma, who regularly intimidated her and took her photographs from the court premises.

ACMM Kamini Lao, on June 19 issued summons to the directors of Uphar Cinema, Gopal Ansal and Sushil Ansal and their two employees Deepak Katpalia and Praveen Sharma charging them with offences under Section 506, 509, 188 and Section 120(b) of the Indian penal code.

They were asked to appear before the ACMM on July 9. Meanwhile the two employees moved an application in the Delhi High Court seeking a stay in the case.

The High court after granting the stay on the summons issued by the ACMM also issued notices to Ms Krishnamurty.

Ms Krishnamurty had earlier moved the court alleging that she had been threatened several times in the past ten years but no protection of any sort from the police had been provided.
