HC directs UGC to include Amity in its list and website

New Delhi, July 3 (UNI) The Delhi High Court today directed Universities Grant Commission (UGC) to include the name of Amity University situated in Uttar Pradesh (UP) in its list of universities and its website.

The court order was an interim relief to Amity as it is still waiting for inspection of its premises by the UGC.

Justice Badar Durrez Ahmed directed the UGC to add the name of Amity in their list as per Section 2(f) of the UGC act being maintained on its website.

The court also directed the UGC to carry out its periodic inspections and point out the shortcomings and deficiencies of the University to it and take consequential action in case those deficiencies are not removed.

The Section 2(f) of the UGC act states that there are provisions where an university, if established and incorporated under State act would be contemplated under the said act.

Amity University had approached the High Court, appealing that though it was registerd with the state of UP as an University, the UGC was not including its name in its list of universities and was not uploading it on its website, wherby their students are being denied admission in higher courses abroad.

The foreign universities check the lists of universities on the website of UGC and when its name was not found, their students were denied admission on the ground that the University was an unrecognised one.

UGC had not included the name of Amity university in their list as the inspection of the University was yet to be carried out.

Counsel for Amity Univerity Neeraj Kaul contented that the UGC maintained a non-statutary list of universities, which fall under Section 2(f) of the UGC act which relates to the institutions other than the universities which have been established and incorporated by a central act or a provincial act or a state act.

Since Amity was in the state of UP and it had qualified the conditions stipulated in Section 4 and 5 of the State act, its name should be added on the website.

The Court ruled that since the UGC has not inspected the premises of Amity University for over two years, it cannot take non-inspection as a ground for denying them a legitimate place in the list maintained by it.
