Kerala HC stays eviction notice against Abad property in Munnar

Kochi, Jun 27 (UNI) The Kerala high court today stayed the notice of eviction and demolition issued by the authorities to Abad Motels and Resorts Pvt. Ltd. regarding its property in Munnar.

Mr Justice S Sirijagan also isssued notice to the state government, the special task force and revenue authorities on the petition filed by Abad Motels and Resorts Pvt. Ltd. represented by its Managing Director Riaz Muhammed.

The petitioner challenged the notice dated June 25, 2007, issued by the tahsildar to evict the land within 24 hours. The petitioner contended that it was entitled to file an appeal or writ petition against the order of the land revenue commissioner who cancelled its patta.

Meanwhile, Justice K M Joseph of the high court today posted the case filed by Kannan Devan Hill Plantation Corporation Private Ltd.

to June 28.

The petitioner has challenged the government notice for taking over its land in Munnar. It contended that the notice was issued without jurisdiction and application of mind.

Additional Advocate General Venganoor Chandasekharan, who appeared for the state government, contended that the petitioner had violated the Kerala Forest Conservency Act and were hence issued notice.
