Delhi HC allows MCD to continue demolition drive in Dilshad

New Delhi, June 27 (UNI) The Delhi High Court today allowed the Municipal Corporation of Delhi (MCD) to continue its ongoing demolition drive against unauthorised constructions in Dilshad Colony, despite the residents wanting an injunction on the ground of not being served with a prior notice.

Vacation Judge Hima Kohli dismissed the petition of the newly formed association of the residents - Federation of Aggrieved Building Flat Owners, terming the drive as within the parameters of law.

Counsel appearing for the MCD, Sumita Kapil, told the court that the MCD had served notices to the offenders to vacate the deviated portions. She said notices under section 343 to 349 of the MCD Act were served much in advance to all the house owners who had deviated certain portions of their flat, thereby violating the rules.

The colony had rampant unauthorised constructions on the Government land. The houses were extended beyond the boundry walls to a large extent, which should have been removed by the residents themselves, the MCD Counsel told the court.

The petitioners contented that they were not served with any prior notice under section 349 of the MCD Act and suddenly MCD personnel came to demolish their houses. They said that Section 343 of the DMC Act, 1957 is an obligatory term before paving its way for demolitions.

The Court, however, allowed the demolitions in Dilshad Colony continue as notices were found to be served earlier.
